These terms are the agreement between you and Kinetiq Travel LLC ("Kinetiq", "we") for using the Kinetiq app and website. By creating an account or using Kinetiq, you agree to them. Please also read the Privacy Policy — it explains how we handle your data and is part of this agreement.
1. Your account
- You must be at least 13 years old (or the higher minimum age where you live) and provide accurate account information.
- You're responsible for what happens under your account. Keep your sign-in method secure and tell us if you suspect misuse.
- One person per account — accounts aren't transferable.
2. What Kinetiq is (and isn't)
Kinetiq helps groups plan trips, see each other on a live map, communicate, and keep shared memories. It is a coordination tool: we don't operate tours, transportation, or accommodation, and — until we say otherwise in the app — bookings you record in a plan are your own reservations with the businesses involved, not purchases from us.
3. Safety features — read this
Kinetiq is not an emergency service.
SOS alerts, route heads-ups, live location, ETAs, and family observing depend on device battery, GPS accuracy, network coverage, and each person's sharing settings. They can be delayed, imprecise, or unavailable. In an emergency, always contact local emergency services first (112 in the EU, 911 in the US). Never rely on Kinetiq as your only safety measure.
- Location appears only for people who have sharing on; incognito means no signal, not "hidden but tracked."
- An SOS alert notifies your group and family observers — it does not contact authorities.
- Heads-ups about route deviation are informational and can produce false alarms or miss real ones.
4. Your content
- You own what you create in Kinetiq — trips, notes, messages, photos, Moments.
- You give us the limited license we need to run the service: to store, process, and display your content to the people you've chosen to share it with, per your settings.
- You're responsible for having the rights to what you upload, and for what you share.
- We may remove content that violates these terms or the law.
5. Shared & published itineraries
- When you share a trip link or publish an itinerary, people you share it with can view and clone the itinerary. Clones are independent copies — edits to a clone don't affect your original, and your personal notes and companions are not included.
- Don't publish itineraries containing other people's personal information without their consent.
6. AI-generated content
Remi's plans and suggestions are generated automatically and can be wrong — places close, hours change, distances mislead. Treat AI output as a draft to check, not a guarantee. You decide what goes into your plan, and you're responsible for verifying details that matter (tickets, opening hours, transport times, local rules).
7. Acceptable use
Don't use Kinetiq to:
- track, harass, stalk, or intimidate anyone — including coercing someone into sharing their location;
- impersonate others, or access another person's account or data;
- upload unlawful content, malware, or content that infringes others' rights;
- probe, overload, scrape, or reverse-engineer the service;
- misuse SOS or safety features for false alarms.
Coerced location sharing is abuse. If someone is pressuring you to share your location, you can go incognito at any time — and we encourage you to contact local support organizations.
8. Third-party services
Maps, places, weather, translation, and notifications are delivered with third-party providers (including Google Maps Platform and Google Cloud). Their availability isn't guaranteed by us, and their terms may apply to your use of those features within the app.
9. Ending the agreement
- You can stop using Kinetiq and delete your account at any time, in the app or via the web.
- We may suspend or terminate accounts that violate these terms, create risk for other users, or where the law requires. Where reasonable, we'll warn you first.
- Sections that by their nature should survive (content licenses already exercised, disclaimers, liability limits) survive termination.
10. Disclaimers & liability
Kinetiq is provided "as is." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-interruption; we are not liable for indirect, incidental, special, or consequential damages, or for events during your travel — including missed connections, closed venues, injuries, or losses arising from reliance on location, ETA, safety, or AI features. Where liability can't be excluded, our total liability is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights that consumer law gives you and that can't be waived.
11. General terms
- Changes. We may update these terms; for material changes we'll notify you in the app before they take effect. Continued use means acceptance.
- Governing law. These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules; mandatory consumer protections of your home country still apply.
- Severability. If a provision is unenforceable, the rest remains in effect.
- Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about Kinetiq.
